I. Definitions

Means Direct Kisan Mandi website, mobile application, software, and related services.

Farmer

Any individual or organization listing agricultural produce for sale.

Buyer

Any customer, trader, wholesaler, retailer, exporter, processor, or business purchasing agricultural produce.

Agent

A person authorized to facilitate transactions between farmers and buyers.

Crop

Any agricultural produce including fruits, vegetables, grains, cereals, flowers, spices, pulses, and other farm products.

Auction

An online bidding process where multiple buyers submit offers for listed produce.

II. Nature of Services

Direct Kisan Mandi is only an online marketplace that connects farmers and buyers.

The Platform may provide:

• Crop listing
• Photo & video upload
• Live auction system
• Direct buying and selling
• Farmer profile
• Buyer profile
• Route planning
• Nearby farmer discovery
• Notifications
• Communication tools
• Price comparison
• Order management
• Logistics information (if available)

The Platform does not purchase, own, store, inspect, transport, grade, or guarantee any agricultural produce.

III. Eligibility

Users must:

• Be at least 18 years old.
• Be legally competent to enter contracts.
• Provide accurate registration information.
• Comply with all applicable Indian laws.

IV. Farmer Responsibilities

Farmers are solely responsible for:

• Accuracy of crop information
• Quantity
• Quality
• Grade
• Weight
• Packaging
• Freshness
• Harvest date
• Photos and videos uploaded
• Pricing
• Delivery commitments
• Compliance with agricultural laws

Any false or misleading information may result in account suspension.

V. Buyer Responsibilities

Buyers are responsible for:

• Verifying crop quality before purchase.
• Confirming quantity and grade.
• Negotiating prices.
• Making payments directly to the farmer unless otherwise specified.
• Inspecting produce before acceptance.

Buyers purchase agricultural produce at their own discretion and risk.

VI. Auction Rules

Where auction facilities are available:

• Farmers may list produce for auction.
• Buyers may submit bids.
• Farmers may accept or reject any bid.
• The highest bid does not guarantee sale.
• Auctions may close automatically or manually.
• Direct Kisan Mandi is not responsible for bids placed by users.

VII. Pricing

Farmers independently decide:

• Selling price
• Auction reserve price
• Bulk discounts
• Delivery charges

Direct Kisan Mandi has no control over pricing.

VIII. Payments

Unless specifically stated:

• Payments occur directly between buyer and farmer.
• Direct Kisan Mandi is not a party to payment transactions.
• We do not guarantee payment collection.
• We are not liable for delayed or failed payments.

IX. Delivery

Farmers and buyers mutually arrange:

• Pickup
• Delivery
• Transportation
• Loading
• Unloading

Direct Kisan Mandi is not responsible for:

• Delivery delays
• Transport damage
• Spoilage
• Theft
• Accidents
• Loss during transportation

X. No Quality Guarantee

Direct Kisan Mandi does not inspect, certify, verify, or guarantee:

• Crop quality
• Freshness
• Size
• Weight
• Taste
• Grade
• Moisture
• Ripeness
• Organic status
• Chemical-free claims

All agricultural produce is sold "As Is".

XI. Inspection

Buyers are strongly advised to inspect produce before accepting delivery.

Once accepted, disputes regarding quality become the responsibility of the buyer and seller.

XII. No Responsibility for Disputes

Direct Kisan Mandi shall not be responsible for disputes involving:

• Quality
• Quantity
• Weight
• Payments
• Delivery
• Transportation
• Fraud
• Crop damage
• Price negotiations
• Misunderstandings between users

Such disputes shall be resolved directly between the parties involved.

XIII. User Conduct

Users shall not:

• Upload false information
• Upload fake photographs
• Misrepresent crop quality
• Commit fraud
• Manipulate auctions
• Abuse other users
• Violate laws
• Use fake identities
• Interfere with Platform operations

Violation may result in permanent suspension.

XIV. Platform Availability

We strive to keep the Platform available but do not guarantee uninterrupted service.

The Platform may occasionally be unavailable due to:

• Maintenance
• Internet issues
• Technical failures
• Server downtime
• Force majeure events

XV. Intellectual Property

All logos, trademarks, software, content, graphics, and technology belong exclusively to Direct Kisan Mandi.

Users may not reproduce or distribute Platform content without written permission.

XVI. Privacy

User information is collected and processed in accordance with our Privacy Policy.

XVII. Suspension & Termination

Direct Kisan Mandi may suspend or permanently terminate any account if the user:

• Violates these Terms
• Commits fraud
• Uploads false listings
• Misuses the Platform
• Engages in unlawful activities

XVIII. Disclaimer

Direct Kisan Mandi is only a technology platform connecting farmers and buyers.

We do not act as:

• Seller
• Buyer
• Commission Agent
• Broker
• Transporter
• Warehouse
• Quality Inspector
• Agricultural Consultant
• Payment Collector

We do not guarantee:

• Crop quality
• Successful sales
• Successful purchases
• Payments
• Deliveries
• Buyer authenticity
• Farmer authenticity
• Profit
• Market prices

All transactions are undertaken solely at the user's own risk.

XIX. Limitation of Liability

To the fullest extent permitted by law, Direct Kisan Mandi shall not be liable for:

• Crop spoilage
• Crop damage
• Loss of income
• Business losses
• Delayed deliveries
• Payment defaults
• Fraud by users
• Transportation losses
• Price fluctuations
• Auction losses
• Indirect or consequential damages

Our total liability, if any, shall be limited to the amount of service fees actually paid to Direct Kisan Mandi for the relevant transaction.

XX. Indemnification

Users agree to indemnify and hold harmless Direct Kisan Mandi, its directors, employees, affiliates, partners, and agents against any claims, liabilities, losses, damages, legal costs, or expenses arising from:

• User misconduct
• False crop listings
• Misrepresentation
• Violation of law
• Disputes between users
• Breach of these Terms

XXI. Force Majeure

Direct Kisan Mandi shall not be liable for delays or failures caused by:

• Natural disasters
• Floods
• Drought
• Fire
• Pandemic
• Government restrictions
• Internet failures
• War
• Civil unrest
• Transportation disruptions
• Power failures

XXII. Governing Law

These Terms shall be governed by the laws of India.

Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts where the Company has its registered office.

XXIII. Acceptance

By registering, listing crops, placing bids, purchasing produce, or using any service on Direct Kisan Mandi, you acknowledge that:

• You have read these Terms.
• You understand these Terms.
• You voluntarily agree to be legally bound by these Terms.
• You understand that Direct Kisan Mandi is only a marketplace and is not responsible for the quality of crops, payments, deliveries, disputes, losses, fraud, transportation, or any transaction between farmers and buyers.

Important Legal Note: If Direct Kisan Mandi plans to facilitate payments, hold buyer funds (escrow), provide logistics, or operate as a commission agent, these Terms should be reviewed by a legal professional to ensure compliance with applicable Indian laws, including the Information Technology Act, Consumer Protection Act, and state agricultural marketing regulations.
